The decision comes after a months-long investigation into the alleged October 2024 incident at Bergview College in Matatiele, Eastern Cape, which sparked national protests and a social media campaign under the hashtag #JusticeForCwecwe.According to SowetanLIVE NPA spokesperson Adv Mthunzi Mhaga, stated that no conclusive evidence of rape or sexual assault was found following interviews and a medical examination of the child. The case docket, initially submitted in November 2024, was reviewed multiple times by both local and provincial prosecutors before the decision was finalised.The announcement has provoked mixed reactions. While some see it as a failure of justice, others have raised concerns about trial by public opinion. Lobby group AfriForum, representing the school principal and caretaker initially implicated in the case, accused the authorities of yielding to social media pressure. According to The Citizen, Barry Bateman of AfriForum’s private prosecutions unit said, “Our assessment of the facts worryingly suggests... the authorities have allowed themselves to be intimidated by nameless and faceless keyboard warriors.”The child’s mother, Thandekile Mtshizana, a police officer and survivor of rape herself, took to social media earlier this year to publicise her daughter's alleged assault. Her emotional TikTok video in March 2025 ignited widespread outrage and mobilised protests nationwide. A petition for justice garnered over 670,000 signatures, while marches under the #JusticeForCwecwe banner drew hundreds, especially in Johannesburg and rural communities.Critics say the case highlights deeper systemic issues. South Africa continues to battle high rates of gender-based violence, with police data showing an average of 118 rapes reported daily. Between 2018 and 2023, over 61 000 rape cases were closed without prosecution, raising serious concerns about the criminal justice system's capacity to handle sexual violence, particularly involving minors.Despite the NPA’s decision, the case may not be fully closed. The police have resubmitted the docket to the Director of Public Prosecutions for further consideration. Civil society organisations, including Women for Change, argue that the public response to Cwecwe’s story must not fade into another news cycle. Founder Sabrina Walter said this case should serve as a “catalyst for systemic reform,” including calls to declare gender-based violence a national disaster.While the state’s legal machinery may have stalled, Mtshizana has vowed to continue seeking justice. Her daughter, once a lively student, now shows signs of severe trauma. “All I can do is fight for her,” Mtshizana said - a reminder that while the legal process has drawn a pause, the emotional and societal reckoning continues.
